Egg donation and surrogacy in the United States of America

Surrogacy is legal and possible in almost all US states. BUT: Each state has very different laws. For example, in one state only married couples, whether heterosexual or homosexual, may be able to carry out surrogacy, while in another state all intended parents, including singles and unmarried couples, may be able to do so.

In some states, the intended parents are granted parenthood by a court ruling BEFORE the birth of the child, a so-called Pre Birth Order. In other states, this is only possible AFTER the birth, i.e. Post Birth Order.

Surrogacy in the USA is commercially structured, which means that the surrogate can demand a fixed amount, known as compensation, from the intended parents.

The relationship between surrogate and intended parents is close in the USA compared to other countries where surrogacy is possible.

The legal process is very well regulated in the USA and court rulings mean that adoption by the intended parents is not necessary. These rulings are recognized in many countries in Europe. This is particularly important for same-sex couples. Both men are recognized as parents.

Egg donation is also permitted in the USA and if the egg donor agrees, the intended parents can also get to know the donor or keep in contact with her.

PGD and sex determination of embryos is legally permitted in the USA.
